現在、この事務所に所属している弁護士に懲戒請求の申し立て中です。 問題の弁護士は、紛議調停や懲戒請求の期間中に、青山の事務所を離れ、こちらへ移ってきた人物です。 依頼していたのは、不当解雇の労働審判による解雇の撤回。 しかし、担当弁護士は、労働審判において弁護活動を行った実体はなく、預けていた書類も紛失。 更に、既に書類が返却済であると、長期に渡って虚偽の主張をし続けました。(当時のボス弁に所在を確認してようやく、未返却であったと判明) 上記から、懲戒請求を行いました。 現在、綱紀委員会にて調査中です。 依頼前、複数の法律事務所に相談し、概ね 「解雇の撤回は妥当だが、解決は裁判になる」 という旨の回答をいただいていたなか、この弁護士だけは、 「労働審判による解雇の撤回の方針で話を進められる」 と回答しました。 解決までの所要期間や精神的負担は、裁判より労働審判のほうが本来軽微のため、労働審判の方向で依頼しました。 しかし、 不当解雇の撤回というのは、多くが裁判で行われ、 労働審判では、要求の正当性に関わらず、審判員は金銭による和解を推し進められがちであることを、他の弁護士の先生から知らされました。 労働審判の場では、 審判員は、金銭による和解に応じないと見るや、高圧的な物腰に態度を変え、 「何もかもあなたの思い通りになどならない」 「我々も暇じゃない」 など、4時間以上にわたり、攻撃的な言葉を伴いながら、和解の合意を求められました。 その間、担当弁護士は審判員の態度を制止することもなく、ほぼ無言。 数時間のなかでの発言は、事務的な確認事項の質問の2~3点のみ。 本来味方であるはずの担当弁護士からはなんの弁護も受けられず、およそ公平とはいえない審判員の態度。 とても辛く、苦しい時間でした。 企業から提示された解決金は、相場よりもかなり高額であったため、当時私の担当弁護士が所属していた、完全成功報酬型の事務所では、多額の解決金から成功報酬を受け取ったほうが、 解雇の撤回を求めるより費用対効果が良かったわけです。 書類の紛失を認めなかった通り、平気で虚偽の申告をする担当弁護士。 書類は、懲戒請求前に行った、紛議調停で未返却であったことを認めました。 予告なく返送されたため受け取れず、その件についての謝罪もなし。 この件が最終的に弁護士会にどう処理されるかはわかりませんが、 私個人はこの件を一生忘れませんし、許せません。 依頼者にそのように思わせる弁護士が所属しています。 担当弁護士が書類の紛失を認める書面、 懲戒請求を受け、審査を開始した綱紀委員会からの通知を掲載します。 もう、同じ思いをする人がいなくなることを願います。
